Road to the Roses Official Rules

The following is an internet based game of skill in handicapping horse races and is intended for participation and viewing in the fifty (50) United States, District of Columbia only and shall only be construed and evaluated according to applicable law. Void where restricted or prohibited.
Participants must be eighteen (18) years of age or older at date of registration and must have a valid, active email address and Internet access prior to March 22, 2013. This game is open only to legal residents of the fifty (50) United States, District of Columbia. All applicable federal and state laws and regulations apply. Contest registration begins at 12:00 p.m. ET, Friday, March 22, 2013 and will be closed to new entries at 5:00 p.m. ET on Thursday March 28, 2013.
NO PURCHASE NECESSARY.
Employees of Churchill Downs Incorporated, jockeys, trainer and owners of horses nominated to the Kentucky Derby or Triple Crown, racing officials and their respective immediate family members or those living in the same household of such individuals are not eligible to win.
By entering, participants agree to release, indemnify and hold harmless Churchill Downs Incorporated (“Sponsor”), its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won.
The Official Rules will be posted on the Kentucky Derby Web site, www.kentuckyderby.com, throughout the contest. By entering this contest, you agree to be bound by these official rules and the decisions of Churchill Downs Incorporated and their sponsors, which shall be final and binding in all respects.
Churchill Downs Incorporated reserves the right to, at its sole discretion, disqualify any individual that: tampers or attempts to tamper with the entry process or the operation of the contest or website, violates the Official Rules or acts in any unsportsmanlike, rude, or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Churchill Downs Incorporated reserves the right to terminate or modify this contest at any time. Note: usernames may not infringe upon any intellectual property rights of others, defame or use profanity, or use other objectionable language or names, any of which could result in disqualification in the sole discretion of Churchill Downs Incorporated.
Any attempt by an entrant or individual to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws. Should such an attempt be made, Churchill Downs Incorporated reserves the right to seek damages from any such person to the fullest extent permitted by law.
To enter the contest, go to www.kentuckyderby.com and provide an email address (which will be kept private) and username (which will be exposed to all other players via the leaderboard), and select six (6) horses from the current field of Triple Crown nominated (active as of 3/22/13) horses to put in a virtual stable. Players will be required to submit their estimate on the official running time of Kentucky Derby 139 to the hundredth of a second without going over that time. This will be used in case of a tiebreaker, in which case the closest guess will win. The only user- initiated action will be the initial entry. No stable changes or other changes after entry are allowed. All registrations must be received by Churchill Downs Incorporated by 5:00 p.m. ET, Thursday March 28, 2013. Sponsor’s clock is the official timekeeping device for this contest. No faxed, mailed, electronically mailed, or phoned-in entries are allowed; this is an Internet-based game only.
Up to five (5) entries per person will be accepted. Duplicate entries are cause for disqualification of all involved entrants and are made at the sole discretion of Churchill Downs Incorporated.
Churchill Downs Incorporated is not responsible for lost, interrupted or unavailable hardware or software or telephone transmission or technical failures, garbled or jumbled transmission or other error of any kind, whether human, mechanical or electronic.
Once submitted, entries and correspondence become the sole property of Churchill Downs Incorporated and will not be returned.
Entrants' stables may consist of six (6) horses selected from the current field of Triple Crown nominated horses listed as active as of March 22, 2013 at 12:00 p.m. ET. Players will be required to submit their estimate on the official running time of Kentucky Derby 139 to the hundredth of a second without going over that time. This will be used in case of a tiebreaker, in which case the closest guess will win. The only user-initiated action will be the initial entry. No stable changes or other changes after entry are allowed.
The entry web page will include or link to an expert picks feature that will assist novice game- players with making their selections.
Users gain points when any horse in their stable gains points in the following races (10 races total).
The second leg of the Road to the Kentucky Derby Championship Series (1st: 100pts; 2nd: 40pts; 3rd: 20pts; 4th: 10pts)
The Wild Card races of the Road to the Kentucky Derby Championship Series (1st: 20pts; 2nd: 8pts; 3rd: 4pts; 4th: 2pts).
Points will also be awarded for top finishers in The Kentucky Derby (1st: 200pts; 2nd: 80pts; 3rd: 40pts; 4th: 20pts).
After each day in which one or more game-affecting races take place, the standings of all game players will be updated on the game website. Users will then be notified via mass email to visit the website and see where they rank on the game-player leaderboard.
Note: Any horse officially winning, placing or showing in the case of a dead heat will be given the place for which it tied for the purposes of determining a participant’s score in this contest.
GRAND PRIZE WINNERS SELECTION
From all eligible entries received, the winner will be the player who accumulates the most points during Road to the Roses according to these Official Rules.
In the event of a tie between two or more eligible entrants, the tiebreaker will be awarded to the player who most closely predicted the official running time of Kentucky Derby 139 to the hundredth of a second without going over that time. The closest guess to the actual finish time will win. In the event that there is still a tie, the winner will be the entrant that scored the most points in the Kentucky Derby. In the event a tie situation still exists, the winning entry will be awarded based on the following tie-breakers:
Most points scored in the final two scoring races (in this case, the Kentucky Derby and Derby Trial).
Most points scored in the final three scoring races (in this case, the Kentucky Derby, Derby Trial and Coolmore Lexington).
Most points scored in the final four scoring races (in this case, the Kentucky Derby, Derby Trial, Coolmore Lexington and Toyota Blue Grass).
Most points scored in the final five scoring races (in this case, the Kentucky Derby, Derby Trial, Coolmore Lexington, Toyota Blue Grass and Arkansas Derby).
Tiebreakers will continue in this manner until the tie has been broken.

Potential winners will be determined on or about June 1, 2013.

Potential winners will be notified by e-mail, regular mail and/or telephone within seven (7) days after the date the winners are determined, and will be required to sign and return tax forms if applicable, and an affidavit of eligibility and acceptance of these "Official Rules" and a publicity/liability release within fifteen (15) days following attempted notification.
By accepting any prize, except where prohibited by law, the winner (and, if applicable to the Grand Prize, companion) grants permission to Churchill Downs Incorporated to use their names and/or likenesses for publicity and promotional purposes without further compensation, and agree to execute a written consent. Winners are responsible for all taxes and must sign all eligibility, release and tax forms. In the event a potential winner cannot be contacted, fails to sign and return all required forms by the deadline established by Sponsor, or otherwise fails to comply with these Official Rules will result in prize forfeiture, and an alternate winner will be selected.
In the event of a dispute about the identity of any entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be required to provide Churchill Downs Incorporated with proof of identity, and proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

A winners' list will be posted on the website, http://www.kentuckyderby.com, after contest completion. While every reasonable effort will be made to maintain and accurately reflect on standings throughout Road to the Roses, Sponsor and its agencies assume no responsibility or liability for the accuracy, completeness or currency of the standings information at any given time. Sponsor reserves the right at any time, without notice or liability of any kind, to revise, amend or modify the standings information. Sponsor may periodically update the standings at time(s) of its sole choosing and in its sole discretion; however, the foregoing does not represent a duty or obligation on behalf of the Sponsor to update any standings and the failure of Sponsor to do so for any reason will not result in liability to Sponsor. For the foregoing reasons, you are cautioned that inclusion of one’s name, stable or other identification on any posted standings does NOT constitute a representation by Sponsor that you have won a prize in the Contest.
